It was an interesting day for the law in the US. The Supreme Court hearing of a challenge to a Virginia law banning cross burning in public view made for some riveting exchanges.
A similar law—which banned the display of any symbols that were known to cause anger or resentment—was struck down in 1992 because it was found to violate freedom of speech guarantees.
But this law is aimed directly at public cross-burning rituals, because it redefines them not as protected hate speech, but as actual threatening conduct, much like somebody with a criminal past brandishing a loaded gun. Indeed, if I were black, based on past history I imagine I would feel very threatened were I to venture near a cross-burning ritual, so it is an eminently reasonable ground for banning the practice, and the Supreme Court seems to agree (we’ll see).
But there are other examples one could find of such practices. A public rally of Nazi types doing the Hitler salute? Jews (and gays and gypsies) might feel threatened by such a display of hate too.
Germany bans Nazi rallies. Why not ban them in the US? White supremacists steeped in Nazi nostalgia preparing for the revolution somewhere in Oregon seem to have more sense than the KKK, and have realized that Nazi rallies are terrible PR. As far as I know, there are no public Nazi rallies in the US. Which is probably why they haven’t been banned specifically. But if and when they happen, they should be.

I am a teacher who was doing a search for background information on the KKK for a lesson in school when I happened to come across this site. The aruguments posed by all are very compelling and I just wanted to post my opinion as well.
Symbols themselves are not threatening. It is only when a group of people begins associating those symbols with a particular meaning that they can become intimidating. The nazi symbol orginially stood for good luck, peace, happiness which is why Hitler championed it. The burning cross actually is supposed to stand for the light of christ shining down.
Fact of the matter is outlawing these symbols or demostrations will help only temporarily. While I can understand the desire for their banning its effects will only last for a short period of time. Soon enough they will begin brandishing some other symbol or sign that once had a good meaning behind it. What are we supposed to do than? Outlaw any symbol that the group decides to champion? Under our consitutional rights we simply can’t.
When the demonstrations become violent is the only time the government can step in. I am NOT defending the messages of the KKK or Nazi groups. They are racist bigots and are detrimental to all this country stands for. Their actions of organizing as a group or displaying symbols is not unconstutional and for EVERYONE’S freedom we can’t outlaw it.
There have been lots of times when a group was against the majority opinion and ended up being right. The abolition of slavery wasn’t popular …what if group opinion had ended that? There is a famous quote from history …”I don’t agree with a word you are saying but I will fight to my death for your right to say it.” That is the way I shape my opinions on this matter and it is one I open up to you all.
